Lasting Power of Attorney

    Appointing a trusted individual with the legal authority to make decisions on your behalf can be an emotional and difficult process. At Simpson Wood we have an experienced team who can deal sensitively with all your lasting power of attorney enquiries and provide you with peace of mind. 

    A lasting power of attorney (LPA) is a way of giving one person or a number of people the legal authority to make decisions on your behalf, should you lack mental capacity at some time in the future. 

    You must be over the age of 18 and have mental capacity (the ability to make your own decisions) when you make your LPA. 

    There are two types of LPA: property and financial affairs, and health and welfare. 

    Lasting power of attorney for property and financial affairs can be used while a person still has mental capacity, with their permission. An attorney can generally make decisions on things such as managing your bank account, investments, paying bills and selling your home  

    Lasting power of attorney for health and welfare covers decisions about health and care, and can only be used once a person has lost mental capacity. An attorney can make decisions on matters such as moving into a care home, medical care and life-sustaining treatment
